MADRID (AFP) – Spanish police have arrested a hacker who allegedly stole data on some 4,000 Nintendo users and then tried to blackmail the Japanese videogame giant, they said Monday.

Nintendo Spain said last week that a hacker on February 6 had stolen the personal data of some 4,000 customers in Spain, and then threatened to denounce the company for negligence to data protection authorities.

Spanish police said in a statement Monday that when Nintendo did not reply to his demands he leaked information on one of the users in an online forum and threatened to release the rest of the data.

Police located the hacker, whose identity was not revealed, and arrested him in the southern province of Malaga, preventing the release of any further data of Nintendo users in Spain, the statement said.

A High Court has ruled that R4’s, M3’s etc – devices that allow gamers to play pirated video games on Nintendo’s DS/DSi handheld system, are illegal in the UK. The courts ruling says “game copiers” are illegal to import, advertise and sell in the UK.

The UK is not the first country to ban the sale of such items. In the Netherlands earlier this month, the Hague District Court ruled that 11 Dutch online retailers acted unlawfully by importing and selling “game copiers” for use with the DS. The defendants in the UK court case – Playables Limited and Wai Dat Chan – had argued that they allow gamers to play home-made games. However the ruling by Justice Floyd reads:

The mere fact that the device can be used for a non-infringing purpose is not a defence… The economic effect on Nintendo of the trade in these devices is substantial as each accused device can store and play copies of many Nintendo DS games

Nintendo also issued a statement on the UK ruling, saying it was:

…pleased that the court was not persuaded by the defendant’s arguments, claiming that game copiers are lawful, as they allow for the play of ‘homebrew’ applications. The court affirmed that game copiers first circumvent Nintendo’s security systems before any non-infringing application can be played on Nintendo’s handheld products.

Playables Limited and Wai Dat Chan were found to have imported nine different variations of the R4 mod chip etc, and HMRC and Trading Standards had already seized more than 165,000(!) of the items which were intended for the defendants.

Romulation.net, a large supplier of ROMs for Nintendo DS testing, has taken the ROMs offline. Their statement:

“The goal of RomUlation has always been to provide users with an opportunity to try out games in order to determine whether it is a game worth purchasing or not. We have always respected when publishers or developers felt RomUlation did more harm than good to the sales of their product.

The owner of this game contacted us with concerns that our service was doing more harm than good, so as per our goal and beliefs we have complied with their request to remove their intellectual property.

This currently covers ALL of the NDS games and is permanent, meaning they will NOT be downloadable again soon.

We understand that this may frustrate users who were looking for new games to test but we hope you also understand that this is both necessary and in accordance with our beliefs.”

Add the Continent of Australia to the list where Game backup cards are illegal to sell…

SYDNEY (AFP) – Gaming giant Nintendo said Friday it had won 556,500 US dollars’ compensation from an Australian firm for selling illegal game-copying devices.

Nintendo said it won a Federal Court case against online console and accessory seller GadgetGear over the gadgets, known as R4 cards, which pirate games for its handheld DS system.

“GadgetGear and its directors have now acknowledged that game copying devices infringe both Nintendo’s copyright and Nintendo’s trademarks and that they are illegal circumvention devices,” the Japanese company said.

“As a result, GadgetGear and the directors have agreed to permanently refrain from importing, offering for sale and/or selling game copier devices.”

GadgetGear and directors Patrick and James Li were ordered to pay Nintendo 620,000 Australian dollars (556,500 US dollars) in damages and hand over all its stock of copiers for destruction.

Nintendo said it was mulling further action against other Australian sellers of pirating gadgets, and would use “all means available to it under the law”.

This month, an Australian man agreed to pay Nintendo 1.3 million US dollars in an out-of-court settlement after illegally uploading New Super Mario Bros. to the Internet six days before its global release.

But not just any calculator, it can be a Texas Instruments TI-83!

How do you do this?

Download Wabbit DS from here. Unzip it.

Move the WabbitXXXXX.nds file one level up.

/—WabbitXXXXX.nds

|–WabbitXXXXX

WAIT! You are going to need the firmware from a TI-83……but it turns out that the update from TI contains the firmware you need, so go to the TI website and download this update “TI83Plus_OS.8Xu”.

Rename the file to TI83Plus_OS.rom.

Copy this file into the WabbitXXXXX folder.

Now copy WabbitXXXXX.nds and the WabbitXXXXX folder to the root of your SD Micro card.

Put your SD Micro card into your AceKard.

Put your AceKard into your DS and turn it on.

Navigate to and Highlight the WabbitXXXX.nds file and press “A”.

The first time, the system will prompt you for a ROM to load. Navigate to the WabiitXXXXX folder, and select the TI83Plus_OS.rom file and press “A”.

Wait a few minutes for the system to initialize. Now go out and have fun!

Note: The folks from TI want you to know that you can use that ROM as long as you OWN a TI-83…..
